Terms of Service

These Terms govern your use of the Echo Soft Skills website at echosoftskills.com (the "Site") and, where applicable, the Echo platform (the "Service"). By using the Site or the Service, you agree to these Terms. If you do not agree, do not use the Site or Service.

"Echo", "we", "us", and "our" refer to Echo Soft Skills Ltd, a company registered in England and Wales with company number 17078603. "You" or "Customer" means the individual or legal entity using the Site or Service.

1. The Service

Echo provides an AI-powered voice roleplay platform for practising high-stakes workplace conversations ("The Rehearsal Method"). Access to the Service is provided under a separate written agreement (a Master Service Agreement or equivalent) between Echo and the Customer. These Terms govern your use of the Site and any pre-agreement trial, demo, or pilot access that we expressly make available.

You may use the Site for your own lawful, non-commercial purposes, or to evaluate the Service for a business. You must not:

Where we grant you access to the Service for the purposes of a demo, pilot, or trial, you are responsible for keeping any credentials secure and for all activity under your account. We may suspend or terminate access at any time, for any reason, where access has been granted outside of a signed Master Service Agreement.

4. Intellectual property

All content on the Site — including text, graphics, logos, images, audio, software, and the underlying design — is owned by or licensed to Echo Soft Skills Ltd. "Echo", "Echo Soft Skills", "The Rehearsal Method", and associated marks are trademarks of Echo Soft Skills Ltd.

No licence is granted except as expressly stated in these Terms or in a separate written agreement. Feedback, suggestions, or ideas you provide to us about the Service may be used by us without restriction or compensation to you.

5. Customer content and data

Any content, audio, or data you submit to the Service during a demo, trial, or pilot ("Customer Data") remains your property. You grant us a limited, non-exclusive licence to process Customer Data solely to provide the Service, for the duration of our relationship.

We do not use Customer Data to train AI models. We handle personal data in accordance with our Privacy Policy. Commercial data processing obligations are set out in the Data Processing Agreement (DPA) that forms part of the Master Service Agreement for paid customers.

6. Fees and payment

Access to the Site is free. Use of the Service beyond a demo or trial is subject to fees set out in a separate written agreement. No commercial use of the Service is permitted without such agreement and, where fees are due, payment in accordance with its terms.

7. Warranties and disclaimers

We provide the Site "as is" and "as available". To the maximum extent permitted by law, we exclude all warranties, conditions, and representations, whether express or implied, including any implied warranties of merchantability, satisfactory quality, or fitness for a particular purpose.

Echo is a development tool. It is designed to help people practise and improve communication skills. It is not an assessment, selection, performance-management, medical, or mental-health tool, and must not be used for those purposes. Nothing on the Site or in the Service constitutes professional, legal, medical, clinical, or HR advice.

8. Limitation of liability

Nothing in these Terms limits or excludes any liability which cannot be limited or excluded by English law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

You agree to indemnify us against any loss, damage, or cost arising from your breach of these Terms or from your unlawful use of the Site.

10. Termination and changes

We may update or discontinue the Site or any of its features at any time without notice. We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent change. Continued use of the Site after a change constitutes acceptance of the updated Terms.

11. General

Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely.

Entire agreement. These Terms (together with the Privacy Policy and, where applicable, the Master Service Agreement) constitute the entire agreement between you and us relating to the Site.

Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be severed and the remainder shall continue in force.

No waiver. A failure or delay by us to exercise a right is not a waiver of that right.

Third parties. No one other than a party to these Terms shall have any right to enforce any of them, save as expressly permitted by the Contracts (Rights of Third Parties) Act 1999 or other applicable law.

12. Governing law and jurisdiction

These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, their subject matter, or formation, are governed by and construed in accordance with the laws of England and Wales. The parties submit to the exclusive jurisdiction of the courts of England and Wales.
